Terms of Service

Operator and scope

These terms apply to ClimbWriter, operated by Torben David Bergner. Operator and contact details are available in the Imprint.

Service

ClimbWriter provides a writing space with a visual daily climb. Writing, local recovery points, and downloadable backups are free. Optional accounts can hold a private cloud copy of daily writing when account access is available.

Plus, pricing and the free trial

Plus adds the writing dashboard, focus sounds, dark mode, and focus mode. Backups and daily competitors remain free. The free all-time community ranking is coming soon. Plus costs USD 6.99 per month or USD 59.88 per year (equivalent to USD 4.99 per month), paid in advance through Stripe. No VAT is charged for supplies covered by the German small-business VAT exemption (§ 19 UStG). Prices include any applicable tax. The total payable and any tax included are displayed before you confirm checkout. We do not add an undisclosed service fee. Your bank may charge currency conversion fees.

Each account can try Plus free for 14 days before its first subscription. Checkout collects a payment method and explains the plan, charge date and recurring price. Unless you cancel before the trial ends, your selected paid plan starts automatically. Trial use is recorded in your account; cancelling does not reset eligibility. A preview or opening the Pricing page alone does not create a subscription.

Subscription renewal and cancellation

Your plan renews automatically until cancelled. You can stop renewal at any time in Account → Manage subscription. You can also use the Cancel subscription form without signing in or email info@climbwriter.com. During a trial, cancel before its end to avoid the first charge. Otherwise, ordinary cancellation takes effect at the end of the current paid period, and Plus remains available until then. Free features and your writing remain available.

If mandatory consumer law gives you an earlier termination date, that date applies. In particular, where German consumer law applies, an automatically renewed contract after the initial term may be terminated with no more than one month's notice. Contact us or specify the requested date in the cancellation form; any prepaid amount for time after the legally effective termination date will be refunded. Your right to extraordinary termination for good cause and mandatory refund rights remain unaffected.

Consumer right of withdrawal

Consumers entitled to a statutory right of withdrawal may withdraw from the subscription contract within 14 days of its conclusion without giving a reason. To exercise this right, send a clear statement to Torben David Bergner, c/o MDC#schaffzeit, Welserstraße 3, 87463 Dietmannsried, Germany, or info@climbwriter.com. Sending the statement before the deadline is sufficient.

If you withdraw, we will refund payments received under that contract, including any applicable standard delivery charges, without undue delay and within 14 days after receiving your notice, using the original payment method unless otherwise agreed, without a refund fee. ClimbWriter does not require you to waive this right to use the free trial or Plus.

Your writing

You retain the rights to text you create. You authorize us to store and process cloud copies only as needed to provide the requested service. Draft text is not published in rankings. Keep a downloaded backup of important writing. Browser storage may be cleared by your browser or device; cloud copies require access to your account.

Accounts and public progress

Keep access to your email account and sign-in links secure. Public rankings show handles and word counts only for writers who choose to share. You can stop sharing in Account. Do not impersonate others or manipulate rankings. For account deletion or access problems, contact us.

Acceptable use

Do not use ClimbWriter to create, store, or share:

• Unlawful content, credible threats, targeted harassment, or content promoting hatred or violence against people or protected groups.
• Pornographic or sexually explicit content primarily intended for sexual arousal, or any sexual exploitation of minors.
• Content that infringes copyright or other rights, exposes another person's private information without a lawful basis, or impersonates others.
• Content intended to harass people because of their religion or beliefs, or deliberately to mock or demean God or sacred figures.
• Malware, fraud, spam, or material intended to compromise the service or other users.

Do not attempt unauthorized access, manipulate word counts or rankings, or interfere with the service. Fiction may explore difficult subjects; depicting a character's wrongdoing is not, by itself, promoting that wrongdoing. The restrictions above still apply.

We may restrict access or suspend an account for serious or repeated violations, taking the circumstances into account. Where appropriate, we will explain the reason and allow you to respond. Urgent security risks or legal obligations may require immediate action. You can report concerns or challenge a restriction using the contact address below.

Availability

Features may change as the service develops. Uninterrupted operation cannot be guaranteed.

Liability

Liability is governed by applicable law. Mandatory statutory rights remain unaffected.
